reopens their recently expired territorial agreement and extends its expiration

Progress Energy Florida, Inc. and extending its expiration date through
Staff Analysis:
In their joint petition, OUC and PEF state that they
have been conducting negotiations for some time on a new territorial agreement
to replace the one just expired. As the
second extension to that agreement was about to expire, it became apparent that
they would need additional time to successfully conclude their
negotiations. Therefore, they have asked
for another six-month extension to continue their negotiations. They believe that the proposed stipulation to
extend the expiration date to
Staff has reviewed the proposed extension of the agreement and believes that it is in compliance with Rule 25-6.0440, Florida Administrative Code, and section 366.04(2)(d), Florida Statutes. The extension will permit the parties to negotiate a new agreement while maintaining the status quo and avoiding uneconomic duplication of facilities. Staff believes, therefore, that the extension is in accordance with Commission policy and the public interest and should be approved. Since this is the third request for an extension, however, and since the parties allowed the agreement to lapse before requesting another extension, staff believes it is advisable to direct the parties to file a status report well before this new extension expires describing the progress of the negotiations. This information will aid staff in monitoring the agreement and determining whether additional Commission action would be necessary to assist the parties in resolving their territorial differences.
Pursuant to section
366.04(2)(d), Florida Statutes, the Commission has the authority “to approve
territorial agreements between and among rural electric cooperatives, municipal
electric utilities, and other electric utilities under its jurisdiction.” The
Commission will approve territorial agreements unless they cause a detriment to
the public interest. Staff recommends
that the Commission approve the Joint petition to reopen and extend the term of
the previous territorial agreement in Orange County, by Orlando Utilities
Commission and Progress Energy Florida, Inc. to
