NOTICE

Persons affected by Commission action on certain items on this agenda may be allowed to address the Commission, either informally or by oral argument, when those items are taken up for discussion at this conference. These items are designated by double asterisks (**) next to the agenda item number.

To participate informally, affected persons need only appear at the agenda conference and request the opportunity to address the Commission on an item listed on agenda.  Informal participation is not permitted:  (1) on dispositive motions and motions for reconsideration; (2) when a recommended order is taken up by the Commission; (3) in a rulemaking proceeding after the record has been closed; or (4) when the Commission considers a post-hearing recommendation on the merits of a case after the close of the record.  The Commission allows informal participation at its discretion in certain types of cases (such as declaratory statements and interim rate orders) in which an order is issued based on a given set of facts without hearing.

 Should the Commission approve the contract option to extend the Sprint Relay contract for one year beginning June 1, 2011?

Recommendation: 

 Yes. Staff recommends that the Commission approve the contract option to extend the Sprint Relay contract for one year beginning June 1, 2011. Rates for traditional telecommunications relay service (TRS) should be $0.89 per session minute and the rate for CapTel captioning service should be $1.54 per session minute for the 2011-2012 contract year. Staff also recommends that the amount of the Sprint performance bond should be $4,582,763 for the 2011-2012 contract option year. 

Issue 2: 

 Should this docket be closed?

Recommendation: 

 No.  This docket should remain open for the duration of the contract period with Sprint as the relay provider. This docket is used to monitor relay and contract issues that arise during the contract term.

Recommendation: 

 Yes. 

Issue 2: 

 Should this docket be closed?

Recommendation: 

 If the Commission approves staff’s recommendation, and no person whose substantial interests are affected requests a hearing to address this matter, then Docket No. 100217-EI should be closed upon issuance of a Consummating Order.  The tariff should be effective as of June 15, 2010, the date of the Commission’s vote.  If a protest is filed within 21 days of the issuance of the Commission’s order, the tariff should remain in effect pending resolution of the protest.  Potential signatories to the tariff should be aware that TECO’s tariff may be subject to a request for hearing, and if a hearing is held, may subsequently be revised.
