 Case Background

On December 16, 2016, Florida Power and Light Company (FPL) filed a petition for approval of a new optional pilot LED Streetlight Tariff (LT-1) and accompanying LED Streetlight Agreement (LT-1 Agreement). The term of the proposed pilot program is three years, from 2017-2019, and the program will begin in the southern portion of FPL’s service territory (Miami-Dade and Collier counties) and then expand northward over a 24-month period. This petition is consistent with FPL’s 2016 rate case settlement which permits the filing of optional tariffs.[1] The Commission has jurisdiction over this matter pursuant to Sections 366.03, 366.04, 366.05, and 366.06, Florida Statutes (F.S.).


Discussion of Issues

Issue 1: 

 Should FPL's proposed optional pilot LED streetlight tariff (LT-1) and accompanying LT-1 Agreement be suspended?

Recommendation: 

 Yes. Staff recommends that the LT-1 tariff and accompanying LT-1 Agreement be suspended to allow staff sufficient time to review the petition and gather all pertinent information in order to present the Commission with an informed recommendation on the tariff and agreement proposals. (Guffey)

Staff Analysis: 

 Staff recommends that the LT-1 tariff and accompanying LT-1 Agreement be suspended to allow staff sufficient time to review the petition and gather all pertinent information in order to present the Commission with an informed recommendation on the tariff proposals.

Pursuant to Section 366.06(3), F.S., the Commission may withhold consent to the operation of all or any portion of the new rate schedules, delivering to the utility requesting such a change, a reason, or written statement of a good cause for doing so within 60 days. Staff believes that the reason stated above is a good cause consistent with the requirement of Section 366.06(3), F.S.


Issue 2: 

 Should this docket be closed?

Recommendation: 

 No. This docket should remain open pending the Commission decision on the proposed optional pilot LED streetlight tariff (LT-1) and the accompanying LT-1 Agreement. (Taylor)
